Home Warranty Exclusions

Exclusions from Warranty Coverage:  The following items are excluded from coverage of this warranty: (paragraph 9)

  1. Any structural and finish element of the project that was not part of the project scope.
  2. Any item covered by a written manufacturer or supplier warranty
  3. Damage due to ordinary wear and tear, abusive use or lack of proper maintenance, including the failure to pull back and dry wet carpeting.
  4. Work not done by Builder or Builder’s contractors.
  5. Loss or injury caused by the elements.
  6. Conditions resulting from condensation on, expansion or contraction or any other kind of movement of materials or soil, including any cracks in grout, caulking, brick, stone or veneer.
  7. Damage caused by changing the grade of your yard, improper landscaping, fencing, patios, or other work, which alter drainage.
  8. Damage to or loss of lawn, plants, shrubs or trees due to improper maintenance (i.e. over or under watering).
  9. Scratches or gouges on floors and countertops not noted in writing at the time of the Buyer’s Orientation.
  10. Chips in ceramic tile counter tops not noted in writing at the time of the Homeowner Orientation.
  11. Chips, scratches and gouges on cabinets, interior handrails, sinks and entry doors not noted in writing at the time of the Homeowner Orientation.
  12. Tearing and gouges on linoleum floor not noted in writing at the time of the Homeowner Orientation.
  13. Scratches, chips and gouges in tubs and shower pans not noted in writing at the time of the Homeowner Orientation.
  14. Discoloration of carpet due to sunlight
  15. Discoloration of tile.
  16. Grout (grout will fade, crack and chip with age.)
  17. Shrinkage of hardwood floors.
  18. Shrinkage of caulking.
  19. Shrinkage, checking, twisting, and cracking of exterior and interior timber
  20. Damage to home due to lack of heat, water or electricity.
  21. Damage resulting from fires, floods, storms, electrical malfunctions, accidents, or other acts of nature.
  22. Insect or animal damage.
  23. Damage from alterations, misuse, or abuse of the covered items by any person.
  24. Cost of mitigating the presence of radon gas in the home.
